Brahminical Court Diluted SC/ST Act on Mahad Satyagraha Anniversary


Dr. Ambedkar on 20th March 1927 led the Satyagraha for the access to water, which was denied for centuries and still is denied at many places in India. While Dalits around India were observing 20th March, Mahad Satyagraha, as a struggle against oppression and fight for equality, the Brahminical court ruled that,

“…no arrest may be effected, if an accused person is a public servant, without the written permission of the appointing authority and if such a person is not a public servant, without the written permission of the Senior Superintendent of Police of the District.”

The judgment dilutes the SC/ST (Prevention of Atrocities) Act 1989 in favour of oppressors. It is another attempt by Brahminical courts to save oppressors. It would not only add another layer to bureaucracy but also discourage SC/STs to come forward and file complaints under SC/ST Act. In how many cases do you think senior (who would most likely be another so-called upper caste ) of so-called upper castes accused give permission to prosecute his/her caste fellow? The chances are negligible. SC/ST Act is hardly used anyways and such attempts are in-line with Hindutva’s agenda of killing any safeguard that is there for the Dalits.

Immediate arrest of the accused under SC/ST Act is necessary as perpetrators of such atrocities threaten and intimidate the victims. By withdrawing such provisions Brahminical government and court have encouraged perpetrators.

Further, what adds to Brahminical courts’ shame is the conviction rate under the Act, which is very poor and in some cases less than 1%. Dalit women have suffered the most and by diluting the SC-ST Act, Dalit women’s condition will become even worse. This is what Brahminical courts and governments want. Nothing new, they rule through controlling the women’s bodies as described in Brahminical books. Rape of Dalit women have registered 500% increase since 2001, as per the RTI reply but Brahminical court still feels the need to dilute SC/ST Act.

Atrocities on Dalits increased

When atrocities on SC/STs have increased many times. What logic Brahminical government has in diluting the SC/ST act?

The logic given by Supreme Court in the ruling is to prevent misuse of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act. Brahminical court said that there shall be no immediate arrest on any complaint filed under the law against public servants.

The logic of Brahminical court doesn’t hold any water. According to the Indian Express’s report for the first time since 2016’s Maratha agitation in Maharashtra which demanded dilution of the Scheduled Castes and Tribes (Prevention of Atrocities) Act, 1989, the Maharashtra Police has informed the state government that contrary to claims, the Act safeguarding the rights of the Dalit community has not been misused. A report with detailed statistics indicating this was recently submitted to the Home Department.

Why doesn’t Brahminical court order investigation into whether Act has been really misused rather than going by Brahminical media’s fake claims and then ruling against the welfare of SC/STs?

Further, it is not the first time that Brahminical court and mindset has tried to meddle with Dalit-Bahujan’s history. On 3rd June 2017, Manyawar Kanshi Ram Eco Park in Lucknow was set on fire by goons, who don’t want to see Dalits’ progress. 3rd June is an important day in the history of Dalit-Bahujans because 3rd June 1995 is the day when BSP chief Mayawati became the chief minister of Uttar Pradesh for the first time. Further, while Dalit were observing Bhima Koregaon anniversary on 1st January 2018, they were attacked by Brahminical goons and then Dalits were arrested! Such is the rule of law in Brahminical India. Brahmins led mod attacked Babri Masjid on the death anniversary of Babasaheb Ambedkar.

While atrocities on Dalits are increasing day by day, diluting SC/ST Act would make the life of Dalits miserable. The Ministry of Social Justice, Government of India, declared “20 March” as “Social Empowerment Day” to commemorate Mahad Satyagraha by Dr B R Ambedkar, in the press release of 20 March 2003 but on 20th March 2018 Brahminical court denied that social empowerment (if any!) through its ruling. All those who believe in justice and equality must come forward and protest against such a draconian ruling against Dalits.

    When mischievous mishras are sitting at the helm of affairs in Supreme court then supreme court manuvadi judges are bound to give mischievous judgements.

      Indeed, such changes in law would lead to increase in atrocities on Dalits with no hope of justice. We all must come forward and protest against it.
